This Privacy Policy explains how Jordan Feldstein LLC d/b/a Inscriti ("Inscriti," "we," "our," or "us") collects, uses, discloses, retains, and protects information when you use the Inscriti website, mobile applications, and related services (collectively, the "Service").

1. Scope

Inscriti is designed for educational institutions and school communities. In many cases, a school controls student-related information and directs how Inscriti processes that information. This Privacy Policy applies to public website visitors, app users, parents/guardians, students, teachers, staff, administrators, and school customers, subject to any signed school agreement or Data Processing Addendum.

2. Information We Collect

·       Account and profile information, such as name, email address, phone number, role, school affiliation, grade/class information, profile image, and login credentials or authentication identifiers.

·       Student and school-related data provided by schools or authorized users, which may include student names, class or grade information, attendance or participation information, directory information, communications, forms, school group assignments, and other school-controlled records.

·       User-generated content, such as posts, announcements, messages, comments, form responses, files, attachments, and other materials submitted through the Service.

·       Uploaded media, such as photos, videos, images, and profile pictures that may include students, staff, parents, school events, or school activities.

·       Device, log, and usage information, such as IP address, device type, operating system, browser type, app version, pages or features used, login activity, crash logs, timestamps, and security events.

·       Communications with us, including support requests, emails, feedback, and administrative correspondence.

·       Payment and subscription information, if paid plans are introduced or used, which may be processed by third-party payment processors.

3. How We Use Information

·       Provide, operate, maintain, secure, and improve the Service.

·       Create and manage accounts, roles, permissions, classes, groups, and school communities.

·       Enable school communications, announcements, messaging, forms, calendars, notifications, media sharing, and related features.

·       Provide customer support, training, troubleshooting, and administrative communications.

·       Monitor performance, prevent fraud or misuse, protect security, and enforce applicable terms.

·       Comply with legal obligations, respond to lawful requests, and protect the rights, safety, and property of Inscriti, schools, users, and others.

·       Develop and improve features using aggregated or de-identified information where appropriate.

4. Student Data

For student data provided by a school, Inscriti acts as a service provider or school official with a legitimate educational interest to the extent permitted by FERPA and applicable law. Inscriti uses student data only to provide, secure, maintain, support, and improve the Service for the school, or as otherwise directed by the school or permitted by a signed agreement. We do not sell student data. We do not use student data for targeted advertising. We do not build commercial advertising profiles on students.

5. FERPA and COPPA

Schools are generally responsible for determining whether FERPA, COPPA, state student privacy laws, or other laws apply to their use of the Service and for obtaining any required consents or providing required notices. For children under 13, where the Service is used for school-authorized educational purposes, the school may provide consent where permitted by COPPA guidance and applicable law. Parents or guardians may contact the school to access, correct, or request deletion of student information controlled by the school.

6. How We Share Information

·       With the applicable school and authorized school community users according to roles, permissions, and school instructions.

·       With service providers that help us host, secure, maintain, support, email, notify, analyze, or otherwise operate the Service, including cloud infrastructure and communication providers.

·       With app stores, identity providers, payment processors, or integrations when users or schools choose to use those services.

·       For legal, security, or safety reasons, including responding to lawful requests, enforcing agreements, investigating misuse, or protecting users and minors.

·       In connection with a business transaction, such as a merger, acquisition, financing, restructuring, or sale of assets, subject to protections required by applicable law and any school agreement.

·       With consent or at the direction of the school, parent/guardian, or authorized user.

7. Cookies and Similar Technologies

We may use cookies, local storage, device identifiers, and similar technologies for authentication, security, session management, preferences, analytics, and performance. Users can manage cookies through browser settings, but disabling essential cookies may affect Service functionality.

8. Third-Party Providers

Inscriti may use third-party providers such as Amazon Web Services for hosting and infrastructure, email and notification providers, analytics tools, authentication providers, payment processors, and other vendors. We require service providers that process personal information for us to use reasonable safeguards and process information only for authorized purposes.

9. Data Retention

We retain information for as long as needed to provide the Service, comply with legal obligations, resolve disputes, enforce agreements, maintain security, and support legitimate business purposes. School-controlled data may be retained or deleted according to the applicable school agreement, DPA, school instructions, and technical backup practices.

10. Data Security

We use reasonable administrative, technical, and physical safeguards designed to protect information, including access controls, authentication, secure cloud infrastructure, encryption in transit where appropriate, monitoring, and backup practices. No internet or electronic storage system is completely secure, and we cannot guarantee absolute security.

11. Parent, Student, and User Rights

Parents, guardians, eligible students, and users may have rights to access, correct, delete, or restrict certain information. For student records controlled by a school, requests should generally be directed to the school. Inscriti will reasonably assist schools in responding to lawful requests as required by applicable agreements and law.

12. U.S. State Privacy Rights

Depending on your location, you may have rights to access, correct, delete, obtain a copy of, or opt out of certain uses of personal information. Inscriti does not sell personal information as commonly understood and does not use student data for targeted advertising. To submit a privacy request, contact privacy@inscriti.com. We may need to verify your identity and may direct school-controlled requests to the applicable school.

13. Children’s Privacy

Inscriti is intended for school-authorized use and may involve children under 13. We do not knowingly collect personal information from children outside the school-authorized or parent/guardian-authorized context. If you believe a child provided information without proper authorization, contact us at privacy@inscriti.com.

14. International Users

Inscriti is operated from the United States. If you access the Service from outside the United States, you understand that information may be processed in the United States or other locations where our service providers operate.

15. Changes to this Privacy Policy

We may update this Privacy Policy from time to time. We will revise the Effective Date when changes are made. Material changes will be communicated as appropriate. Continued use of the Service after the updated policy becomes effective means you acknowledge the updated policy.
