These Terms of Service (“Terms”) govern your access to and use of the Inscriti website (https://inscriti.com) and mobile application (collectively, the “Service”), operated by Jordan Feldstein LLC (“Inscriti,” “we,” “our,” or “us”).
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service.
1. Eligibility and Use
Inscriti is intended for use by educational institutions, including students, parents, teachers, and administrators. By using the Service, you represent that you have the authority to use the platform in your role and, if applicable, that you are using the Service under the supervision or authorization of a school or parent/guardian.
If you are under the age of 13, you may only use the Service through a school or with parental or guardian consent.
2. Accounts and Registration
To access certain features, you must create an account. You agree to provide accurate and complete information and to keep your account credentials secure. You are responsible for all activity that occurs under your account.
We reserve the right to suspend or terminate accounts that provide false information, violate these Terms, or pose a risk to the platform or its users.
3. Role of Inscriti as a Platform
Inscriti provides a communication and management platform for schools. We do not control or direct how schools use the Service and do not act as the owner of school data.
Schools are responsible for:
Managing user access and permissions.
Ensuring compliance with applicable laws (including FERPA and COPPA).
Determining what data is uploaded or shared.
Obtaining any required parental or user consent.
Inscriti acts as a service provider and processes data on behalf of schools.
4. User Content and Conduct
Users may create, upload, or share content, including messages, posts, files, and media (“User Content”). You retain ownership of your User Content, but you grant Inscriti a limited, non-exclusive, worldwide license to host, store, and display such content solely for the purpose of operating the Service.
You agree not to:
Upload or share unlawful, harmful, abusive, or inappropriate content.
Harass, threaten, or impersonate others.
Upload content that violates intellectual property rights.
Use the Service for any unauthorized or non-educational purpose.
Attempt to disrupt, hack, or interfere with the platform.
We reserve the right to remove content or restrict access at our sole discretion.
5. Media and Student Content
The Service allows users to upload and share photos, videos, and other media, which may include images of students or school activities.
By uploading media, you represent and warrant that:
You have all necessary rights and permissions to upload and share the content.
You have obtained any required consent, including parental consent where applicable.
Schools are solely responsible for ensuring that media shared through the platform complies with their policies and applicable laws. Inscriti does not independently verify consent or permissions related to uploaded media and is not responsible for unauthorized use of images by users.
6. Data and Privacy
Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection and use of information as described in that policy.
7. Payments and Future Features
Inscriti is currently provided at no cost. However, we reserve the right to introduce paid features, subscriptions, or pricing plans in the future. Any such changes will be communicated in advance.
8. Intellectual Property
All content, features, and functionality of the Service (excluding User Content) are owned by Inscriti and are protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the Service without our permission.
9. Termination
We may suspend or terminate your access to the Service at any time, with or without notice, if you violate these Terms or if we determine that your use poses a risk to the platform or its users. You may stop using the Service at any time.
10. Disclaimers
The Service is provided on an “as is” and “as available” basis. We do not guarantee that the Service will be uninterrupted, secure, or error-free.
We are not responsible for:
Content uploaded by users or schools.
Actions taken by users within the platform.
Any decisions made by schools based on information in the Service.
11. Limitation of Liability
To the fullest extent permitted by law, Inscriti and Jordan Feldstein LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of profits, or loss of use, arising out of or related to your use of the Service.
Our total liability for any claim shall not exceed the amount you paid to use the Service (which is currently $0).
12. Indemnification
You agree to indemnify and hold harmless Inscriti and Jordan Feldstein LLC from any claims, damages, losses, or expenses arising out of:
Your use of the Service.
Your User Content.
Your violation of these Terms.
Your violation of any rights of another person.
Schools agree to indemnify Inscriti for claims related to student data, consent, and compliance with applicable laws.
13. Modifications to the Service
We reserve the right to modify, suspend, or discontinue any part of the Service at any time without notice.
14. Changes to These Terms
We may update these Terms from time to time. Continued use of the Service after changes are posted constitutes acceptance of the updated Terms.
15. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to conflict of law principles.
